when can the police request a breath test?

Only a uniformed police officer can ask you to provide a sample of breath. The request can be made of any person who is driving, attempting to drive, or in charge of a motor vehicle on the road, or in a public place. A public place is not limited to the road - a car park or forecourt and almost anywhere with public access is deemed a public place.

The police have to reasonably believe that one of the following conditions applies for a breath test to be lawful:

  1. That you have committed a moving traffic violation.
  2. That you have been involved in a road traffic accident.
  3. That you have consumed alcohol

can you be stopped at random and breath tested?

The police have the right to stop your motorcycle at random. However, they may only insist upon a breath test if one of the three conditions listed above applies. Wicked quotes have unique rates for convicted driver insurance, DR10 insurance and drink drive motorcycle insurance.

what are the drink drive limits?

The currently (2009) legal limits of alcohol in the body are :

  • 35 micrograms of alcohol per 100 millilitres of breath
  • 80 milligrams of alcohol per 100 millilitres of blood
  • 107 milligrams per 100 millilitres of urine

what happens next?

If the amount of alcohol in your body is above any of the limits prescribed above, you will be arrested and taken into police custody. At the police station you will be required to co-operate in providing two further specimens of breath for analysis in one of the more accurate "approved evidential instruments" such as a Lion Intoxilyzer

The lower of the two readings is used to establish guilt or innocence. If you are found to have committed an offence you will be charged.

failing to provide a specimen

You do NOT have the right to insist on providing a sample of blood or urine instead.

Failing to supply a specimen of breath is an offence in itself and can result in a longer period of disqualification. Only a medical condition that prevents you from supplying sufficient breath might be considered a reasonable excuse and only then if you tell the police about it at the time. Being drunk and incapable is not considered a reasonable excuse.

You may be required to provide a specimen of blood or urine as an alternative to a breath test, in the following circumstances:

  • No approved evidential instrument is available or working properly when you are arrested
  • Medical advice indicates that you may be under the influence of illegal drugs
  • Police have reasonable cause to believe that a breath sample cannot be obtained for health reasons

what happens when you are only just over the limit?

Drink drive motorbike insurance for convicted riders / banned rider insurance is hard to get.

Where the lowest breath reading is less than five points over the limit (i.e. 36 to 39 micrograms) you should be released, probably with a caution, but with no charge.

Where the lowest reading is up to 50 micrograms it is a LEGAL REQUIREMENT that you are offered the opportunity of supplying a specimen of blood or urine as an alternative.

In the absence of a medical condition that would preclude you from providing a particular type of specimen the police can decide which option you are offered. You will either have to supply two samples of urine within one hour or the police surgeon will take a blood sample. A blood sample can only be taken with your consent but if this is the option offered, and you refuse, the police may then rely on the breath sample alone.

can I drive after being charged?

The police will not allow you to drive after leaving the police station if you are still over the limit.

Disqualification from driving only begins after your court hearing (assuming you are found guilty), so until then you free to drive.

how can I get my licence back early?

Only where the ban was for more than two years and once a minimum of 2 years has been served can you apply to the court for the remainder of the disqualification to be waived. You would have appear in person before a court and satisfy it of the following:
